En 2026, contester un licenciement abusif en France relève des compétences de la Direction départementale de l’emploi, du travail et des solidarités (DDETS) et du conseil de prud’hommes. Comment procéder
Pour contester un licenciement abusif, commencez par envoyer une lettre recommandée avec accusé de réception à votre employeur dans les 12 mois suivant la notification du licenciement (délai légal en vigueur depuis 2023). Joignez-y votre courrier de rupture et tous les éléments probants (emails, témoignages, évaluations). Ensuite, saisissez le conseil de prud’hommes via le téléservice sur prudhommes.justice.gouv.fr. Vous devrez remplir le formulaire cerfa n°15504*03 et désigner un représentant si vous êtes affilié à un syndicat. Une médiation préalable est désormais obligatoire depuis 2026: elle dure 30 jours maximum. Si elle échoue, une audience est programmée. Présentez vos arguments et preuves devant le bureau de jugement. Un jugement peut être rendu en appel devant la Cour d’appel dans les 15 jours suivant la décision. En cas de reconnaissance du licenciement abusif, l’employeur peut être condamné à une réintégration ou à une indemnité compensatoire.
